Member: A person who provides information to the Company to participate in the Service as a paid member.
User or Potential Match: A person who provides information to the Company to participate in the Service as a free match (e.g., “Are You The One” matches).
You / Your: Any person using the Website or Services in any capacity.
These Terms apply to all use of the Website and Services, including any correspondence by email, phone, or other means between you and Gayquation.
This Agreement is an electronic contract that sets out the legally binding terms for your use of the Website and Services.
By accessing the Website or using any Services, you consent to receive these Terms electronically. You may request a paper copy by sending a letter and self-addressed stamped envelope to:

We may change, alter, or modify these Terms at any time. Changes become effective when posted on the Website. Your continued use of the Website or Services after changes are posted constitutes your acceptance of the updated Terms. It is your responsibility to review the Terms periodically.
By using the Website, registering an account, becoming a Member, or purchasing/accepting any Services, you acknowledge that you:
Have read, understand, and agree to these Terms;
Agree to our Privacy Policy, Cookie Policy, and Dating Safely Tips; and
Agree to any additional terms disclosed to you when purchasing or accepting specific services.
If you do not agree to all of the above, do not use the Website or Services.
You must be at least 18 years old to access or use the Website or Services. Access or use by anyone under 18 is strictly prohibited.
By using the Website or registering, you represent and warrant that:
You are 18 years of age or older;
You have the right, authority, and capacity to enter into this Agreement;
You are legally unmarried;
You will use the Website in compliance with all applicable laws and regulations; and
You have not been convicted of a felony and are not required to register as a sex offender with any government authority.
Membership is void where prohibited. Gayquation reserves the right to refuse service to anyone for any reason or no reason.
You may register as a free Potential Match, but free registration does not entitle you to member contact details or guaranteed matches.
To access full matchmaking and related features, you must become a paid Member and pay the fees listed in our then-current price list (which forms part of this Agreement). We may change fees at any time.
By registering, you agree to:
Provide accurate, current, and complete information as prompted in your profile (“Account Profile”);
Update your information as needed to keep it accurate, current, and complete;
Submit at least one recent, true-to-life photograph (taken within the past 3 months) of yourself. You understand that:
Submitting no or inaccurate photos may delay matchmaking timelines;
Marketing of members and third-party acceptance of your profile may be affected without a valid photo.
You agree that we may rely on your registration data as accurate and complete. If your data is untrue, inaccurate, not current, or incomplete, we may terminate your membership and/or access to the Services without refund.
Right to Exclude
Gayquation may reject any registration, or terminate any account, at its sole discretion and may refund fees in full or in part as it sees fit. We reserve the right to deny participation in any Gayquation event or service.
By becoming a Member, you elect to commence services immediately and waive any “cooling-off” period that might otherwise apply under local laws.
This Agreement remains in effect while you use the Website or Services, and continues to apply even after your membership is terminated, especially regarding dispute resolution, limitations of liability, and indemnity.
You may terminate your membership at any time by contacting customer service or your lead matchmaker.
Either you or Gayquation may terminate membership at any time, with or without cause, by providing written or email notice.
Refunds on Termination
If we terminate your membership without cause, we generally do not provide prorated refunds unless explicitly stated under our Refund and Guarantee Policy.
If you terminate your membership, or if we determine you violated these Terms or our Privacy Policy, you are not entitled to any refund of unused membership fees, and we may bar your future use of the Services.
If a formal complaint is filed against Gayquation, membership may be placed on hold while the matter is reviewed.
If you cancel via the Website, please allow up to 72 hours for processing.
Your use of the Services is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By registering or using the Services, you agree to the collection, use, and disclosure of your information as described therein.
While we use reasonable safeguards, we cannot guarantee absolute security of data transmitted over the Internet. You agree to release Gayquation and its affiliates from claims arising out of third-party access to information you provide, to the fullest extent permitted by law.
If you are a California resident, you waive California Civil Code Section 1542, which states:
“A general release does not extend to claims which the creditor does not know or suspect to exist in his favor at the time of executing the release, which, if known by him must have materially affected his settlement with the debtor.”
You agree that any comments, ideas, suggestions, concepts, reviews, techniques, or other material you submit to us (“Feedback”), including responses to questionnaires and postings on the Website, may be used by Gayquation worldwide and in perpetuity, without compensation, for any purpose, including:
Developing, improving, and marketing services
Creating or modifying products and features
To the extent permitted by law, you waive any “moral rights” in such Feedback.
Gayquation does not accept unsolicited ideas for TV shows, movies, etc. If you submit such material, you do so with the understanding no additional consideration will be given, even if similar content is later produced.
The Services may not be accessed or used where prohibited by law.
You understand that, through the Services, you may encounter content or behavior deemed mature, offensive, indecent, or otherwise objectionable. This may result from interactions with other users or members.
YOU ASSUME ALL RISK arising from use of the Services, including online and offline communications and in-person meetings (such as dates). You are solely responsible for exercising caution and taking all necessary safety precautions when interacting with people you meet through Gayquation.
You are solely responsible for your interactions with other users and members.
We have no obligation to:
Screen users or members;
Inquire into their backgrounds; or
Verify statements made by users or members.
We make no warranties regarding the conduct, intentions, or compatibility of users and members. We may, but are not obligated to:
Monitor disputes between users;
Block or terminate members for violations;
Conduct background checks using publicly available records.
If you find another user’s content offensive or harmful, you may use any reporting tools we provide.
Release of Claims
In the event of a dispute with one or more users or members, you release Gayquation, its affiliates, officers, directors, employees, and agents from all claims and damages of any kind arising from such disputes.
If you are a California resident, you again waive California Civil Code Section 1542 as quoted above.
Gayquation does not guarantee that:
You will receive a particular number of matches;
You will meet or date any specific person;
Any match will lead to a relationship; or
Any relationship outcome will result from introductions or events.
Some aspects of the Services are designed, in part, for amusement and entertainment.
Gayquation strives to provide a safe, non-invasive environment and upholds the integrity of its services.
We may conduct a preliminary soft profile check, which can include:
Verifying identity via public or third-party profiles;
Verifying photos as authentic;
Verifying location via IP or similar tools;
Verifying contact information;
Conducting certain criminal background checks, where permitted.
However, Gayquation does not comprehensively verify:
Employment or education;
Full criminal history or sex offender registries, except where specifically indicated;
Credit or other background checks beyond what is explicitly described.
You acknowledge that it is your sole responsibility to conduct any additional checks you deem necessary before meeting or engaging with another person.
Members agree to:
Conduct themselves respectfully during and after dates, workshops, and events;
Provide feedback to Gayquation after an Insta-Date or first date if they are using Momentum or related services.
Gayquation has no responsibility for the outcome of any relationship that may form from an introduction or event.
You agree to promptly report any violations of these Terms by others.
Gayquation reserves the right, but not the obligation, to monitor, remove, or edit any content submitted or posted on the Services if we believe it violates the law or these Terms, or is otherwise objectionable.
You will not provide inaccurate, misleading, or false information to Gayquation or its users. If your information becomes inaccurate or misleading, you must promptly update it or notify Gayquation.
We may use your email and/or phone number to:
Send important updates about the Services;
Seek or confirm your permission for introductions;
Notify you of special offers (subject to applicable consent).
You are responsible for:
Maintaining the confidentiality of your email, username, and password;
Restricting access to your account;
Notifying us promptly of any unauthorized use.
If you share your password or payment details, you understand that others may be able to alter or access your account. You are responsible for all activities conducted under your account.
Gayquation offers customer support, coaching, webinars, and educational content. These are:
For informational and entertainment purposes only;
Not a substitute for professional medical, psychological, or therapeutic treatment.
You acknowledge that Gayquation and its staff are not licensed doctors, nurses, psychologists, or therapists.
When communicating with customer service or matchmakers, you may not engage in abusive, obscene, offensive, threatening, or harassing behavior. We may record calls for quality assurance. If your conduct is inappropriate, we may immediately terminate your access without refund.
You may send comments, complaints, or success stories to info@gayquation.com. Success stories and testimonials may be used in marketing without compensation.
You agree to pay all charges incurred in connection with your Billing Account using your selected payment method (“Payment Method”). We may correct any billing errors even after requesting or receiving payment.
If you initiate a chargeback on a legitimate charge, we may terminate your account immediately. If the dispute is resolved in our favor, your account may remain closed and you are not entitled to reinstatement or refund.
Fraudulent chargebacks (reversing legitimate charges) are prohibited. We may cooperate with payment processors, banks, and law enforcement by providing evidence of the transaction, communications, and membership history.
Your membership may renew automatically at the end of each period at the rate you agreed to, unless you cancel in advance. If you do not wish to renew, you must contact us or follow website instructions to cancel before your current term ends. No prorated refunds are provided for partial periods.
You must keep your Billing Account information current and accurate. If your payment method fails, we may suspend or terminate your membership, or continue attempts to process payment. Upon successful payment, your membership may resume and your new billing cycle will run from the date payment is received.
You may request to place your membership on hold by contacting support@gayquation.com or your matchmaker. Holds commence from the date of notification. You must notify us when you wish to lift the hold.

We are confident in the Gayquation process and our professional matchmakers. We want our clients to feel secure in our matchmaking services. If we fail to provide the number of matches specified in your membership during any given month, we reserve the right to implement one or more of the following resolutions.
a) Match Roll-Over
If we do not deliver the number of matches included in your membership during a given month, any undelivered matches will roll over to the following month.
Example: If you are a 3’s A Crowd member (2 matches per month) and receive only 1 match in a particular month, the remaining 1 match will roll over to the next month, giving you a total of 3 matches owed that following month.
b) Membership Pause for Excess Owed Matches
If your owed matches exceed three times your monthly membership total, your lead matchmaker may recommend pausing your billing while your owed matches are fulfilled.
You will remain an active member during this pause.
All owed matches remain guaranteed.
If four or more matches roll over and your owed total becomes six or more, you may opt to either continue or cancel your membership (subject to the refund rules below).
a) Refund Before Interview & Assessment
Refunds may only be requested if you have not yet completed the hour-long interview and assessment with your lead matchmaker.
A refund request must be submitted via email and processed by customer service upon initial sign-up.
b) Post-Interview Refunds (Limited & Discretionary)
Once the interview has been conducted and your intake process started:
Refunds are only granted in extreme cases, at the sole discretion of Gayquation administration.
If more than three (3) months have elapsed since your last introduction, partial refunds may be approved. These partial refunds are applied by reducing your balance of introductions (matches owed).
The initial month of membership (or first set of introductions) is non-refundable, as it covers:
The intake and interview process
Matchmaking efforts to date
Optima Market Reports
Insta-Match and Mystery Match access
Virtual events
Any Coaching, Momentum, or other included services
For 6-month memberships (and similar packages with a defined multi-month term):
If your match balance remains unfulfilled within nine (9) months of your start date, a partial refund will be issued, reducing your match balance by 1, 2, or 4 matches, depending on your membership level.
Thereafter, additional partial refunds may be provided every two (2) months if your balance remains unfulfilled. Each refund is applied by reducing your remaining match balance.
Your first 1, 2, or 4 matches (depending on membership level) are non-refundable, as they cover:
Intake & interview
Early matchmaking efforts
Market reports
Insta-Match, Mystery Match, and virtual events
Any Coaching, Momentum, or other bundled services
The following matches do not count toward your total and will be replaced:
Matches who are already previously acquainted with you
Matches who fail to initiate communication in a reasonable timeframe
Matches who materially misrepresent themselves
If a match does not respond or misrepresents themselves, they will be replaced and will not be counted toward your fulfilled total.
Rolling over matches is normal and depends on various factors, including demographics, your location, and your preferences/criteria.
Your matchmaker will provide an honest assessment of match availability and timelines during your interview and throughout your membership.
No guarantees are made regarding:
The exact number or timing of matches
The willingness of matches to communicate, respond, or engage
Honor System: To prevent abuse and protect resources, matchmakers may consider a client’s search completed if:
We have provided more than twice the remaining matches owed,
We have saturated your area by at least 75% within a 25-mile radius, and
We have invested 20+ additional service hours beyond the standard scope.
In such cases, the matchmaker may close or pause the active search while still honoring any outstanding obligations in accordance with these Terms.
If you terminate your membership or violate our Terms, no refunds will be issued.
If a formal complaint is filed against Gayquation, your membership may be placed on hold while the matter is investigated and resolved.
If you cancel your membership via the Website, a reasonable processing period of up to 72 hours is required.
These membership termination rules should be read together with the general Term & Termination and Limitation of Liability provisions in this Agreement.
Month-to-Month Memberships
Billed on the same calendar day each month (e.g., May 4, June 4).
No long-term contract; cancellation can be requested at any time.
If you cancel, you retain access to your benefits until the end of your current billing cycle. No prorated refunds are issued for partial months.
6-Month, Platinum, Platinum Plus & Diamond Memberships
Typically billed as a one-time, non-recurring payment or as agreed at the time of purchase.
If you cancel, you retain benefits until the earlier of:
Your match balance being fulfilled, or
Market saturation reaching 75% in your defined area (as reasonably determined by your matchmaker).
No refunds will be issued for any portion of the membership fee once services have commenced, except as outlined in this Refund & Guarantee Policy.
Owed Matches & Billing Pause
If owed matches exceed three times your monthly total, your matchmaker may recommend pausing your membership to prevent further billing and avoid over-accumulation of unmatched credits.
Timeframes for delivering owed matches are not guaranteed, but:
Clients with rolled-over matches are generally given priority in the search queue.
For these premium tiers, Gayquation offers a relationship-based guarantee:
Gayquation guarantees that you will be introduced to someone with whom a relationship is established within 3, 6, or 12 months, respectively, depending on your membership level.
A “relationship” is defined as:
At least three (3) in-person dates, and
Mutual interest confirmed by separate interviews with both parties by Gayquation staff.
If, by the end of your defined membership term, a relationship (as defined above) has not been initiated:
You may receive a full refund of your membership fee; and/or
Your membership may be extended for another 3, 6, or 12 months (matching your original term) at no additional cost, as specified in your individual agreement.
Additional conditions:
Memberships cannot be converted from one level to another (e.g., Platinum to Diamond) during the active term.
You may not cancel a Platinum, Platinum Plus, or Diamond membership before completing its full term (3, 6, or 12 months), even if you begin a relationship outside of Gayquation.
Refunds under this guarantee are processed after the completion of your membership term to ensure consistent and fair application of the guarantee.
Refunds, if applicable, are processed within 30 days and may be provided in up to 10 monthly installments.
At Gayquation, we value transparency and fairness. If a refund is approved, we typically issue it in installments rather than as a single lump sum. This structure allows us to:
Keep You Active
Even if a refund is being processed, your Gayquation membership and services may remain active so you do not lose out on potential matches or opportunities.
Ensure Consistency & Quality
By spreading refunds over several months, we can continue to provide ongoing support, coaching, and matchmaking without interruption, maintaining a high standard of service for all clients.
Balance Operations & Honor Commitments
Installment-based refunds help us maintain smooth operations, support dedicated matchmakers and staff, and honor all refund commitments responsibly and sustainably.
For example, in the case of a Platinum Membership, if a refund is issued after a complimentary extension and extensive service delivery, processing the refund in installments helps cover significant operational costs while still ensuring your refund is guaranteed and on schedule.
No refunds are provided for unused portions of membership if you independently establish a relationship outside of Gayquation.
Your matchmaker will typically provide a market assessment and updated timeframe after approximately 6–8 weeks, often via your dedicated market report.
This Refund & Guarantee Policy forms an integral part of your Membership Agreement and these Terms of Service. Where any ambiguity arises, Gayquation’s interpretation will prevail, subject to applicable law.
The Services are for personal, individual use only. You may not:
Use the Website or Services for any commercial, business, or organizational purpose;
Advertise or solicit anyone to buy or sell products or services;
Send chain letters, junk mail, or spam;
Use information obtained from the Services to contact other users for commercial purposes without their explicit consent.
If you send unsolicited bulk communications (“spam”) through the Services, you agree that Gayquation may seek statutory penalties and damages, and you agree to pay Gayquation $50 per unsolicited communication as a reasonable estimate of harm, in addition to all other legal remedies.
You may create only one unique profile and must use the Services only for bona fide relationship-seeking purposes.
Gayquation may:
Match you with individuals within or outside its membership database;
Offer free introductions (e.g., “Are You The One” matches);
Use algorithms, demographics, criteria, and preferences in match selection;
Screen profiles within the scope of GQ Protect.
You are under no obligation to meet any match. We may create test profiles for quality and monitoring purposes.
You may not harass, threaten, or intimidate any Gayquation employee, contractor, or agent. We may terminate your account immediately if you do so.
We may disclose information you provide if:
Required by law or legal process;
Necessary to protect Gayquation’s or others’ rights or property;
Necessary to protect someone’s health or safety;
We suspect abuse (e.g., domestic, child, elder abuse, or neglect) and deem it appropriate to contact authorities.
You consent to such disclosures where permitted by law.
By using the Services, you agree that Gayquation may use anonymous, aggregated information about you and your experience to conduct research, improve the Services, or publish findings (e.g., in academic journals). Your personally identifiable information will not be disclosed in such publications.
The Website may contain links to third-party websites, ads, or resources. Gayquation:
Does not endorse or control these third-party sites;
Is not responsible for their content, privacy practices, or any losses or damages arising from your use of them.
You should review the third party’s own privacy policy before providing any personal information.
Any advice, opinions, statements, or other content provided by third parties (including users) are solely those of their authors. We do not guarantee their accuracy or endorse them, and you rely on them at your own risk.
TO THE MAXIMUM EXTENT PERMITTED BY LAW:
THE WEBSITE AND SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED.
WE DISCLAIM ALL IMPLIED WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, SECURE, ERROR-FREE, OR THAT DEFECTS WILL BE CORRECTED.
WE ARE NOT RESPONSIBLE FOR THE CONDUCT, ONLINE OR OFFLINE, OF ANY USER OR MEMBER.
TO THE MAXIMUM EXTENT PERMITTED BY LAW:
GAYQUATION SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF DATA OR SERVICE INTERRUPTIONS.
WE SHALL NOT BE LIABLE FOR DAMAGES ARISING FROM THE CONDUCT OF YOU OR ANY OTHER USER, INCLUDING BODILY INJURY OR EMOTIONAL DISTRESS RESULTING FROM MEETINGS OR COMMUNICATIONS.
YOU AGREE TO INDEMNIFY AND HOLD GAYQUATION AND ITS AFFILIATES HARMLESS FROM ANY CLAIMS, LOSSES, LIABILITIES, OR EXPENSES (INCLUDING ATTORNEYS’ FEES) ARISING FROM:
Your breach of these Terms;
Your content or communications;
Your use of the Website or Services; or
Your violation of any law or third-party rights.
Content you post or submit through the Services may be visible to others and is considered non-confidential. By posting content, you grant Gayquation a worldwide, perpetual, irrevocable, sublicensable license to use, reproduce, modify, distribute, display, and create derivative works from such content for any purpose connected with the Services.
You may not:
Harass or harm other members using information obtained from the site;
Promote prostitution, escort services, “sugar daddy/money slave” arrangements, or any exchange of sexual services for payment;
Reference such arrangements in your username, profile, or communications.
Gayquation may remove any content, including photos, that it deems misleading, inappropriate, or unreasonably unrepresentative (e.g., professional or edited images that do not reflect your real-life appearance).
All site content, trademarks (“Gayquation,” “333 Rule,” “Gayquotient,” “Insta-Match,” etc.), and proprietary material are owned by or licensed to Gayquation and may not be used without our prior written consent.
These Terms, together with the Privacy Policy, Cookie Policy, and any additional membership agreements or policies referenced herein, constitute the entire agreement between you and Gayquation.
If any provision is found invalid or unenforceable, the remaining provisions will remain in full force and effect.
Our failure to enforce any provision shall not be a waiver of that provision or any other.
